10.11 | Functions of Defence Service Commission

  1. The Defence Service Commission Defence Forces Services Commission has the following functions—
    1. to appoint qualified and competent persons to hold posts or ranks in the Defence Forces;
    2. to fix and regulate conditions of service, including salaries, allowances and other benefits, of members of the Defence Forces;
    3. to ensure the general well-being and administration of the Defence Forces and their maintenance in a high state of efficiency;

  1. There is a Defence Forces Service Commission consisting of–
    1. a chairperson, who must be the chairperson of the Public Service Commission or his or her delegate; and
    2. at least two and not more than seven other members appointed by the President.
  2. Persons appointed to the Defence Forces Service Commission must be chosen for their ability and experience in administration or their professional qualifications or their general suitability for appointment, and at least one of them must have held senior rank in the Defence Forces for one or more periods amounting to at least five years.
  3. The Defence Forces Service Commission has the functions that are conferred or imposed on it by this Constitution or an Act of Parliament, and these functions may include–
    1. appointing persons to hold posts or ranks in the Defence Forces;
    2. fixing and regulating conditions of service of members of the Defence Forces;
    3. determining the nature of disciplinary powers to be exercised over members of the Defence Forces, and the manner and circumstances in which they are to be exercised;
    4. ensuring the general well-being and administration of the Defence Forces and their maintenance in a high state of efficiency;
    5. making regulations for any of the purposes set out in this subsection.

The functions of the Defence Forces Service Commission shall be to tender such advice and do such other things in relation to the Defence Forces as are provided for by this Constitution or by or under an Act of Parliament. [Chapter as substituted by section 9 of Act 4 of 1993 – Amendment No. 12 with effect from 1.7.1994]
