Constitution of Zimbabwe (at 13th Feb, 2009)
  1. The President shall not, while in office, be personally liable to any civil or criminal proceedings whatsoever in any court.
  2. Without prejudice to the provisions of subsection (1), it shall be lawful to institute civil or criminal proceedings against a person after he has ceased to be President, in respect ofโ€”
    1. things done or omitted to be done by him before he became President; or
    2. things done or omitted to be done by him in his personal capacity during his term of office as President; and, notwithstanding any provision contained in any law relating to prescription or to the limitation of actions, the running of prescription in relation to any debt or liability of the President, whether incurred or accrued before or during his term of office, shall be suspended during his term of office as President.

  1. While in office, the President is not liable to civil or criminal proceedings in any court for things done or omitted to be done in his or her personal capacity.
  2. After a person has left office as President, civil or criminal proceedings may be instituted against that person for things done or omitted to be done
    1. before he or she became President; or
    2. in his or her personal capacity while he or she was President.
  3. The running of prescription in relation to any debt or liability of the President arising before or during his or her term of office is suspended while he or she remains President.

National Constitutional Assembly (NCA) Draft Constitution (2001)

No official of the State, including the President, the Prime Minister, a Minister, a Judge and a Member of Parliament, is immune from criminal prosecution or civil suit for acts performed in his or her personal capacity.
