77 | Removal of President from office

Law Society of Zimbabwe: Model Constitution of Zimbabwe (2010)

The National Assembly and Senate may, by a resolution passed at a joint sitting by the affirmative votes of at least two-thirds of their total membership, remove the President from office on the grounds of—

    1. gross misconduct rendering the President unfit to continue in office;
    2. inability to perform the functions of his or her office through infirmity of body or mind;  or
    3. a violation of this Constitution.

Kariba Draft Constitution
  1. The Senate, sitting as a court, at the request of at least two-thirds of the Members of the National Assembly, may—
    1.  impeach and remove the President from office for-
      1. serious misconduct;
      2. failure to obey, uphold and defend this Constitution; or
      3. wilful violation of this Constitution; or
    2. remove the President from office on the ground that he or she is unable to exercise the functions of the office because of physical or mental incapacity.
  2. A resolution to remove the President from office must be passed by at least two-thirds of all the members of the Senate.
  3. The Chief Justice presides over any proceedings in the Senate for the impeachment or removal from office of the President.
  4. After the National Assembly has requested the impeachment or removal from office of the President in terms of subsection (1), the President has no power to dissolve Parliament under this Constitution until the proceedings are completed.

National Constitutional Assembly (NCA) Draft Constitution (2001)

The National Assembly and Senate may, by a resolution adopted with the support of not less than two thirds of their total membership, remove the President from office on the grounds of: -

    1. gross misconduct rendering the President unfit to continue in office or
    2. inability to perform the functions of his or her office by reason of infirmity of body or mind or
    3. a violation of this Constitution.
